From 1 July 2021, there is a requirement for aged care providers to obtain informed consent from the aged care resident or their substitute decision maker about restrictive practices (environmental restraint, physical restraint, mechanical restraint, chemical restraint and seclusion). Restrictive practices must only be used as a last resort strategy. Restrictive practices are practices which are used for the primary purpose of influencing a person’s behaviour. An Enduring Guardian is considered to be an appropriate substitute decision maker for restrictive practices. If you do not already have an Enduring Power of Guardianship and Enduring Power of Attorney in place, you can find information about how to put these in place, including forms to complete, through the Office of the Public Advocate WA [https://www.publicadvocate.wa.gov.au/]. The Office of the Public Advocate has also released a position statement about restrictive practices [Public Advocate _ Restrictive Practices_ Position Statement 2].
The Citizen Advice Bureau WA [https://www.cabwa.com.au/] has factsheets about Enduring Power of Guardianship and Enduring Power of Attorney – copies of the factsheets can be found here: [Enduring_Power_of_Attorney] [Enduring_Power_of_Guardianship].
